Your Agreement with Errigal Training Centre

Please read these Terms & Conditions carefully in relation to your confirmed booking. Once a course booking has been secured, Errigal Training Centre and all thepersons named on the booking ("the client(s)") will have entered a binding contract on the basis of these Terms & Conditions. If you have any questions about our Terms & Conditions please do not hesitate to contact us.

"Errigal Training Centre" refers to Ionad Oiliuna an Earagail Teo T/A Errigal Training Centre, Unit 3, Ballyconnell Industrial Estate, Falcarragh, Co Donegal, F92 HC95.

1. Agreement
Agreement on the basis these Terms & Conditions arise upon the fulfillment of all of the following: receipt by Errigal Training Centre of a guaranteed deposit or purchase order number (in the event of a company) clearance of the payment or deposit into Errigal Training Centre’s bank account and acceptance by Errigal
Training Centre in writing.

Errigal Training Centre reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and Errigal Training Centre will return any payment accompanying the booking.

The agreement is between Errigal Training Centre and the client(s) and is the sole agreement between those parties. No variation of these Terms & Conditions shall be applicable unless agreed in writing by Errigal Training Centre before the relevant course.

The agreement is governed by Irish law.

2. Payment

A €300 deposit is required to confirm your place on our package courses. Payment in full must be received before commencement of training. Full payment required on booking individual courses.

Payment can be made by credit/debit card or BACS/EFT. Accepted applications will be acknowledged and joining instructions will be sent prior to the start of course.

Our payment terms for credit accounts are strictly 30 days from the date of invoice.

3. Prices
Whilst every effort is made to limit prices to those given in the booking, Errigal Training Centre reserves the right to alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials).

In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price.

In the event of the price being thus increased by 15% or more the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.

4. Cancellation by client(s)
If the booking is cancelled by the client(s) (for any reason) the following cancellation charge will arise:

- Cancellation more than 21 days before course: 100% of deposit refunded.
- Cancellation less than 21 days but more than 72 hours: 50% of deposit refunded.
- Cancellation less than 72 hours before the course: no refund on any payments made.

The client acknowledges that it is reasonable for such penalties to arise, given the need for Errigal Training Centre to make preparations for a course substantially in advance of the course. The company further acknowledges that extenuating circumstances may arise and these will be addressed on a case by case basis.

Any course cancelled by Errigal Training Centre will entitle the Client to receive a full refund on any/all monies paid or offer of alternative course date without penalty fee.

5. Cancellation by credit client(s)
If the booking is cancelled by the client(s) (for any reason) the following cancellation charge will arise:

- Cancellation more than 21 days before course: No fee applicable
- Cancellation less than 21 days but more than 72 hours: 50% of course cost incurred
- Cancellation less than 72 hours before the course: 100% of course cost incurred

An appropriate invoice will be raised upon notification.

The client acknowledges that it is reasonable for such penalties to arise, given the need for Errigal Training Centre to make preparations for a course substantially in advance of the course. The company further acknowledges that extenuating circumstances may arise and these will be addressed on a case by case basis. Any course cancelled by Errigal Training Centre will entitle the Client to receive a full refund on any/all monies paid or offer of alternative course date without penalty fee

6. Course Date Changes
Should a customer wish to change the date of their course where there is a place available, an administration fee of €25.00 will apply.

In the event that a client does not show up for training or are late arriving into the centre, they will lose their full deposit.

7. The conduct of a course
The client acknowledges that during an Errigal Training Centre course he/she is required to submit to the reasonable instructions and leadership of Errigal Training Centre. The client acknowledges that persons attending an Errigal Training Centre course are entitled to expect a high standard of conduct and regard for personal well being on the part of all clients.

For this reason the client accepts that Errigal Training Centre may, in its absolute discretion and without the need to give reasons, arrange for him / her to be removed from a course, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course. In such circumstances the client will not be entitled to a refund of monies and Errigal Training Centre will not be liable for any losses so resulting. The client will on demand reimburse Errigal Training Centre its reasonable costs of effecting his / her removal.

8. Liability
Errigal Training Centre courses take place in our training facility and are by their very nature not absolutely free from hazard. Errigal Training Centre makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain by a continual process of Risk assessment and instruction by trained professionals only. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without Errigal Training Centre being at fault and accepts that to that extent he/she is taking part in an Errigal Training Centre course at his/her own risk. The client fully accepts that such hazards will include but not be limited to, knocks, bruises, slips, trips and falls, water ingestion, smoke filled environment for example. The client further indemnifies Errigal Training Centre against such claims.

Errigal Training Centre only accepts liability for physical injury to a client that is shown to result from negligence on the part of Errigal Training Centre.

The client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of Errigal Training Centre) howsoever arising is not the responsibility of Errigal Training Centre and that Errigal Training Centre’s liability is hereby limited.

Errigal Training Centre does not guarantee that the result of any training course will be satisfactory for the purposes of the Client. Any liability of Errigal Training Centre to a client arising out of breach of contract, errors, omissions, negligence or otherwise in respect to any training course shall be limited to a sum not exceeding, the price of the course including all legal and other costs incurred by the client in relation to any claim or claims that are brought under the contract

9. Complaints
In the unlikely event that a client has cause for complaint about an Errigal Training Centre course, complaint should be made to a representative of Errigal Training Centre during the event, in order that corrective action can, if necessary, be taken. Errigal Training Centre has a dedicated Complaints Procedure in Place that any client may avail of. The client acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved, complaint should be made in writing within 14 days. To the extent permitted by law Errigal Training Centre will not be liable in respect of claims first intimated later than 14 days from the close of the relevant course.

10. Certification
Certification will not be issued unless the delegate produces one form of valid photographic identification i.e. drivers licence or passport.

Certification will not be issued unless you have the correct valid prerequisites and that you bring evidence of same on the first day of your training course. If any prerequisite is not met the delegate will not be eligible to commence the course. (Please double check these before you arrive on-site.)

Errigal Training Centre will not issue Course Certificates to any delegate until course fees are received in full.

11. Subsequent instructions by client(s)
Although, as stipulated above, all Errigal Training Centre courses are taught by highly experienced & capable leaders, it is not intended that any instruction provided to any client(s) while on a course will in any way qualify that/those client(s) to instruct any third party & no warranty is made to that effect.

Errigal Training Centre hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any Errigal Training Centre course.

12. Re-sits
In the event that a delegate fails to reach the required standard, a re-sit fee will apply. The Directors will make a decision in this regard on a case by case basis relevant to course requirements and circumstances.

13. Intellectual Property
All intellectual property rights in material supplied on courses is subject to copyright and owned by Errigal Training Centre and therefore any duplication in whole or in part is strictly prohibited.

Courses are not to be recorded in any way without the prior written consent of Errigal Training Centre.

14. Errigal Training Centre reserves the right to update the Terms & Conditions at any time, without notice
